Terms of sale

1. The seller

TKA DESIGN SAS, a simplified joint-stock company with a share capital of €1,500, trading as TKA Paris, 16 rue de l'Exposition, 75007 Paris, France. Registered in Paris under number 951 770 494. VAT number FR94951770494. Email: info@tkaparis.com.

2. Scope

These terms apply to every sale made on tkaparis.com to consumers. By placing an order you accept them.

3. Pieces

Each piece is described with its materials, its origin and photographs. Some pieces are in stock; others are made to order, and the expected shipping date is shown before you order. Colors may vary slightly from screen to screen.

4. Prices

Prices are in euros. For deliveries within the European Union they include VAT at the rate of the destination country. For deliveries outside the European Union they are shown without EU VAT and do not include import duties, import taxes or customs fees, which are paid by the recipient. Shipping costs are shown at checkout before payment.

5. Orders

The contract is formed when we send the order confirmation by email. We may cancel an order in the event of a payment failure, an obvious pricing error or suspected fraud, and will refund any amount paid.

6. Payment

Payment is due in full when you order, by card or the other methods offered at checkout. Payments are secured by our payment provider; we never see your full card details.

7. Delivery

Pieces are delivered to the address given at checkout, by the carriers and within the times set out in our Shipping Policy. If a piece is not delivered by the date or within the time we gave you, you may ask us to deliver within a reasonable additional period and, if we do not, cancel the order and be refunded in full (Article L216-6 of the French Consumer Code).

8. Right of withdrawal

You have 14 days from delivery to withdraw from the contract without giving a reason, except for pieces made to your measurements or personalized at your request (Article L221-28 3° of the French Consumer Code). To withdraw, tell us clearly, for example by email to info@tkaparis.com or with the model form below. Send the piece back within 14 days of telling us; the return cost is paid by you. We refund the price and the standard delivery cost within 14 days of receiving your request, using the same payment method, and may wait until we receive the piece. Details are in our Refund Policy.

9. Legal guarantees

All pieces are covered by the legal guarantee of conformity (Articles L217-3 to L217-20 of the French Consumer Code), for two years from delivery, and by the guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code). Under the guarantee of conformity you may ask for the piece to be repaired or replaced, or, failing that, for a price reduction or a refund.

10. Liability

We are not liable for delays or failures caused by events beyond our reasonable control. Nothing in these terms limits liability that cannot be limited by law.

11. Personal data

Your personal data is processed as described in our Privacy Policy.

12. Intellectual property

The designs, photographs, texts and logos on tkaparis.com belong to TKA DESIGN SAS and may not be reproduced without written permission.

13. Disputes and mediation

Please write to info@tkaparis.com first; we will do our best to find a solution. If we cannot, you may refer the dispute free of charge to a consumer mediator (Article L612-1 of the French Consumer Code). The name and contact details of our mediator will be published on this page.

14. Governing law

These terms are governed by French law. If you live in another country, you keep the protection of the mandatory consumer law of that country.
